The VACSB has identified a number of issues we believe are critical to acknowledge if we are to be able to identify what is needed and find ways to develop solutions for the MH and SA needs of offenders, both adult and juvenile.
- In terms of roles, policies, procedures, and regulations, there is no Code requirement or direction for all the state and local agencies involved in this issue to plan for, develop, fund and provide these services, with one exception. The General Assembly has mandated that some first-time offenders receive a SA assessment, which would identify needed services. Funding for the assessment was made available, but not for the services, except for some limited provisions later through the SABRE effort in prisons.
With no Code direction and requirement for a system, the services depend upon the good will of local agencies and to what extent these services are viewed as important.
