Award of Virginia military medals. Provides that Virginia military medal and decorations shall be made in the United States. The bill provides that existing stocks of Virginia military medals and decorations which are of foreign origin may be consumed without violating the provisions of this act. All Virginia military medals and decorations shall have the words "Made in the USA" stamped on the reverse side. This act shall not limit the country of origin of United States military medals and decorations that are presented to members of the Virginia National Guard.

Mr. Webb petitioned the Governor for executive clemency and was granted an absolute pardon in 1996 for all offenses for which he was convicted. Of the total amount, $225,000 is payable over 10 years through an annuity.

Claims; McDaniel, Roger L. Provides $13,675 in relief for Roger L. McDaniel, to be paid from the Onsite Sewage Indemnification Fund. Mr. McDaniel purchased property in Frederick County, Virginia, in August 1990 based on an existing septic system permit issued for the property by the State Board of Health in 1987. When the permit expired in 1991, the Board refused to renew the permit or issue a new permit for a septic system and required the installation of an alternative discharge system which caused Mr. McDaniel to incur additional costs.

Claims; Slis, Robert A. and Victoria R. Provides for the payment of $5,850 from the Onsite Sewage Indemnification Fund to Robert and Victoria Slis for repairs to the sewage disposal system at their residence. The Health Department negligently inspected and approved the installation of the system by an unlicensed contractor in 1991. After the system failed in 1995, it was learned that the contractor installed a drainfield with an area of 780 square feet, rather than 1,440 square feet as required by the construction permit. The Health Department has revoked the operations permit for their four-bedroom home, and reissued a smaller capacity permit which reduces their home's value.

Claims; estate of Arlene C. Bergers. Provides for the payment of $2,719.68 to the estate of Arlene C. Bergers. The late Mrs. Bergers and her husband overpaid state income taxes on their federal retirement income from 1985 through 1988 by that amount. Mrs. Bergers received the forms required to participate in the Harper settlement legislation, and told her daughter that she had signed and returned the forms to the Department of Taxation. The Department has told the executor of her estate that Mrs. Bergers did not sign the required form. Mrs. Bergers was hospitalized and receiving chemotherapy throughout the relevant period.

The purpose of the bonds is to provide funds for paying, together with any other available funds, the cost of the continued construction of an adequate, modern, safe, and efficient highway system along Virginia's southern border, which comprises the Route 58 Corridor. The bill authorizes the Transportation Board to issue the bonds to be sold through the Treasury Board, either at public or private sale. The bonds are not backed by the full faith and credit of the Commonwealth.

Claims; Canterbury Village subdivision. Provides for the payment of $124,000 for the relief of residents of the Canterbury Village subdivision located in Fauquier County. The water supply for the subdivision failed due to the owner's continued failure to comply with the law pertaining to the operation of a waterworks over the course of several years. The bill provides for $62,000 of the payment to come from the state treasury and $62,000 to come from the general fund appropriation to the Department of Health state local cooperative health budget from such funds that would be appropriated to the Fauquier County Health Department. The bill also provides for the Department of Health to place the funds in escrow to be used to cover the expenses of connecting the subdivision to an adjoining waterworks system.

Claims; Hyder, Lowe & Galston. Provides for the payment of $2,015.90 to the Hyder, Lowe & Galston law firm for unreimbursed expenses the law firm incurred to defend an out-of-state lawsuit. The law firm and a member of the law firm were defendants in the suit filed in the State of Washington which involved the firm member's actions as guardian ad litem for a minor child. The suit was dismissed for lack of jurisdiction, improper venue and insufficient process. While the litigation expenses of the firm member were reimbursed by the Division of Risk Management, the expenses for the firm were not.

The purpose of the bonds is to provide funds for paying, together with any other available funds, the cost of maintaining, restoring, repairing, improving, and refurbishing the physical plants, including incidental equipment, of higher education and related educational facilities. The full faith and credit of the Commonwealth is pledged for the payment of the principal of and interest on the bonds and any bond anticipation notes or refunding bonds. The bill authorizes the Treasury board, by and with the consent of the Governor, to fix the details of such bonds, to provide for their sale at public or private sale, to borrow money in anticipation of the issuance of the bonds, and to issue refunding bonds. The bill shall not become effective, and no bonds shall be issued unless and until voter approval is obtained.

Claims, Russell, Beverly Q. Permits Beverly Q. Russell the opportunity to pursue her claims against the Commonwealth by the Commonwealth waiving protection afforded by sovereign immunity. Mrs. Russell was an employee of the Department of Mental Health, Mental Retardation and Substance Abuse Services at Catawba Hospital. In the course of her duties, Mrs. Russell was injured by a violent patient. Worker's compensation has not fully compensated Mrs. Russell for her losses.

Subject to approval by a majority of the qualified voters of the Commonwealth voting thereon at the November 2, 1999, general election, authorizes the issuance of Commonwealth of Virginia Park and Recreational Facilities Bonds pursuant to Article X, Section 9 (b) of the Virginia Constitution in an amount not exceeding $111,410,000. The purpose of the bonds is to provide funds for paying, together with any other available funds, for financing the acquisition of interests in land and any structures thereon for park and recreational facilities, state parks, state forests, and sites of historic significance and for the preservation of natural resources. The full faith and credit of the Commonwealth is pledged for the payment of the principal of and interest on the bonds and any bond anticipation notes or refunding bonds. The bill authorizes the Treasury board, by and with the consent of the Governor, to fix the details of such bonds, to provide for their sale at public or private sale, to borrow money in anticipation of the issuance of the bonds, and to issue refunding bonds. The bill shall not become effective, and no bonds shall be issued, unless voter approval is obtained.

Regional sports organizations; inspection of records. Requires regional sports organizations to make all financial books and records relating to the operation and administration of the organization available to members thereof for inspection upon request. This right of inspection shall exist without reference to the duration of the membership and may be exercised only during reasonable business hours or at a mutually convenient time and location. The bill defines "regional sports organization" as any voluntary, nonprofit organization or association which is exempt from taxation under § 501 (c) (7) of the Internal Revenue Code serving a specific geographic area and which operates a sports or other recreational program for the children of its members.

Claims; Shivers, Robert and Lori. Provides $1,038 in relief for Robert and Lori Shivers. The Shiverses moved to Rockingham County, Virginia, from California in 1994. They filed tax returns for both California and Virginia in 1995 for the 1994 tax year. In 1998, they received notification from the State of California that they had miscalculated their income. The Shiverses subsequently filed an amended 1994 tax return in Virginia which calculated an additional refund of $1,038. They were informed by the Department of Taxation that the three-year time deadline for filing an amended return had passed.

Claims; Finn, Michele, John Finn and other relatives of Hugh Finn; health care decision educational program. Provides for the payment of $48,000 to Michele Finn and of $10,000 to John Finn on behalf of other relatives of Hugh Finn to reimburse them for costs incurred in court actions related to her actions as guardian of her late husband, Hugh Finn. Mr. Finn suffered brain damage in an automobile accident in 1995. In 1998, he was diagnosed as being in a persistent vegetative state and having no reasonable possibility of recovery. When Mrs. Finn made plans to withdraw the feeding tube that was sustaining him, relatives of Mr. Finn sued unsuccessfully to overturn her decision. The Commonwealth instituted suit to block the removal of the feeding tube. The measure also requires the Virginia State Bar to implement a program of educating the bar and the public about health care decision planning.

Claims; Duncan, Sarah Kelly. Provides relief for nine-year-old Sarah Kelly Duncan who was born on March 12, 1989, and suffered severe birth-related neurological injuries during the labor or delivery process because of oxygen deprivation. At the time of Sarah Kelly Duncan's birth, the definition of birth-related neurological injury included in the statute was stringent and could not be met by some infants who were neurologically injured in a hospital at birth or immediately thereafter. The claim filed on behalf of Sarah Kelly Duncan in 1997 was evaluated on the basis of the early definition and was ultimately denied. However, the objective medical panel's opinion supported the contention that her condition meets the present definition of "birth-related neurological injury." The present definition was approved in 1990 through two bills which revised the definition by striking the requirements to be permanently nonambulatory, aphasic, and incontinent and inserting requirements for permanent motor disabilities and developmental disabilities or cognitive disability. The infant must require permanent assistance in all "activities" of daily living. This bill authorizes the legal representative of Sarah Kelly Duncan to seek relief through the Virginia Birth-Related Neurological Injury Compensation Act as though the current definition of birth-related neurological injury was in effect at the time of her birth. The Workers' Compensation Commission, which administers this Act, must make a determination of whether the current definition is met and, if so, make an award to Sarah Kelly Duncan under the Act from the Fund.

Claims; Price, William D., Jr., and Mary B. Provides $3,150 in relief for William D. and Mary B. Price. The Department of Transportation constructed an access drive connecting their property to the relocated Old Danville Road about 10 years ago. The drive has largely washed away because it was built of gravel and tar on a steep slope. VDOT has refused to rebuild the access drive.

Claims; Stophel, Henry. Provides $65,000 in relief for Henry Stophel, contingent upon his deeding his property in Henry County to the Commonwealth. Beginning with rains from Hurricane Fran, Mr. Stophel's property has sustained severe soil erosion and mud slides. The house was built on unstable soil, and the combination of soil saturation from heavy rainfall and the presence of the road cut at the toe of the slope caused the failure of the soil. The erosion problem was exacerbated by the Department of Transportation's removing fill dirt from a highway adjacent to his property following the initial mud slide in 1996. The assessed value of Mr. Stophel's property is less than the cost of constructing improvements to stabilize the hillside.
