Virginia Correctional Enterprises; mandatory procurement. Eliminates the mandatory requirement for state agencies to purchase those articles produced or manufactured, and services provided, by prisoners sentenced to state correctional facilities. The bill also provides that such articles and services may be sold on the open market. This bill has been incorporated into HB 1506.

Prisons; commitment of state prisoners. Allows local jailers and superintendents to request that the Director of the Department of Corrections evaluate their overcrowding or staff shortages and to expedite transfer of state responsible offenders to the state correctional facilities. Current law gives the Director 60 days to accomplish the transfer. The bill, as amended, would prohibit intake of any out-of-state prisoners until all persons convicted of felonies who are state- responsible have been received into the state correctional system.

Commitment of convicted persons to Department of Corrections. Clarifies that there is no distinction between a felony sentence of one year and a felony sentence of 12 months, and requires that offenders with sentences of 12 months or more are state-responsible prisoners and should be transferred to the Department. However, the Director may exercise discretion in receiving such offender and allow him to serve his time in a local correctional facility. Also, no person convicted of a felony and/or misdemeanor with a combined sentence of less than 12 months shall be transferred to the Department without the consent of the Director.
