Allows the circuit court clerks of Richmond County, Franklin County, Wise County, and Greene County and the City of Norton to request that a cover sheet be filled out on all real estate documents which provides pertinent information to the clerk for indexing purposes. This same provision was added in 1998 for the clerks of Wise County and the City of Norton through an uncodified act. This bill codifies that act. The pilot projects created by these enactments expire on July 1, 2002. This bill is identical to HB 1834.

Number of circuit court judges. Increases the number of circuit court judges authorized for the Fifteenth Judicial Circuit from six to seven. The Fifteenth Judicial Circuit consists of the following jurisdictions: The City of Fredericksburg and the Counties of Caroline, Essex, Hanover, King George, Lancaster, Northumberland, Richmond, Spotsylvania, Stafford, and Westmoreland. The bill also removes unnecessary language dealing with the family court.

Felony fees. Establishes a fixed felony fee ($428), a fixed felony revocation fee ($131), a fixed fee for felony reduced to a misdemeanor ($200) and a fixed misdemeanor revocation fee ($87.50) to be paid by convicted felons and misdemeanants and those whose suspended sentences or probations have been revoked. These fees aggregate smaller fees collected by the clerks for distribution to various funds upon conviction or revocation of suspended sentence or probation. Fractional shares of the fixed fees will be paid over to the various funds.

Virginia Supreme Court; uniform statewide formatting standards for cover sheets on deeds and other instruments. Requires the Supreme Court to adopt uniform statewide formatting standards for cover sheets on deeds and other real property instruments by December 1, 1999, in consultation with the Virginia Circuit Court Clerks' Association. After the uniform standards are adopted, circuit court clerks may request, but not require, that cover sheets be submitted with deeds and other instruments for the purpose of properly indexing same. Effective December 1, 1999, the bill also repeals Chapter 378 of the 1998 Acts of Assembly, which allowed the circuit court clerk of Wise County and the City of Norton to request that a cover sheet be filled out on all real estate documents. The bill is a recommendation of the Joint Commission on Technology and Science.

Virginia Supreme Court; uniform statewide formatting standards for land records indexing. Requires the Supreme Court to adopt uniform statewide formatting standards for land records indexing by December 1, 1999, in consultation with the Virginia Circuit Court Clerks' Association. The initial standards must include the land records indexing standards developed by the Land Records Management Task Force pursuant to a prior act of the General Assembly and be implemented in the circuit courts by December 1, 2000. The bill is a recommendation of the Joint Commission on Technology and Science. This bill has been incorporated into HB 1441.

Allows a plaintiff attorney's fees against the Commonwealth if a court finds that the Commonwealth deprived any person of his due process or equal protection guarantees and specifically includes any action on the part of the government which (i) discriminates against any person on the basis of his race, religion, or gender, or (ii) violates the fundamental right and duty of a parent to direct the upbringing and education of the parent's child.

Appellate jurisdiction of the Court of Appeals. Grants jurisdiction to the Court of Appeals to review interlocutory appeals of pendente lite orders of support only when (i) matters of significant precedential value are raised, (ii) immediate review will advance the termination of litigation or clarify important legal issues for the parties or the public, (iii) failure to allow an appeal of the interlocutory order or decree would result in an undue hardship upon one of the parties, or (iv) immediate review is necessary in order to attain the ends of justice. Presently, an order of support cannot be appealed until there is a final order of the trial court. This exception would allow interlocutory appeals only in limited cases and is a recommendation of the Virginia Bar Association.

Definitions of costs recoverable by prevailing party in a lawsuit. Defines recoverable costs in a trial action to include filing fees, fees for service of process, fees for issuance of subpoenas and, in the discretion of the court, costs of the taking and transcribing of depositions. The bill also defines costs recoverable by the prevailing party on appeal to include costs of copies of transcripts, briefs, appendices and petitions for rehearing.

Appointment of guardians ad litem for children. Provides that the circuit court is authorized to appoint a discreet, qualified and competent attorney at law as guardian ad litem to represent the interests of a child in any case involving custody, guardianship, visitation or support of the child which is pending in the circuit court or in any case appealed from the juvenile and domestic relations district court and that compensation for such guardians ad litem is in accordance with the juvenile code provisions. This assures that such guardians in circuit court cases are paid by the Commonwealth under the same scheme as guardians appointed to serve in the district court.

Land Records Management Task Force. Extends the existence of the Task Force until July 1, 2000. The Task Force originally developed out of a report by the Joint Legislative Audit and Review Commission entitled The Feasibility of Modernizing Land Records in Virginia, Senate Document No. 20 (1997).
