Title II public entities include prisons (state and local)
Prohibits denial of benefits or services, programs or activities based on “qualified individual with a disability”
Notes:
- The Americans with Disabilities Act is another broad body of law applicable to state prisons and jails.
- Title I of the ADA regulates employment, Title II state and local government entities, Title III Public Accommodations, and Title IV telecommunications.
- In 1998, the Supreme Court ruled that Title II of the ADA specifically applied to state prison systems and local jails.
- In substance, the ADA prohibits discrimination in the provision of services, benefits or programs based on a disability.
