Statewide Cancer Registry. Requests the Joint Commission on Health Care to study Virginia's Statewide Cancer Registry. In 1998 estimate of 1.23 million new cases of cancer nationwide was estimated. The Joint Commission is directed among other things, to examine the effectiveness of the Statewide Cancer Registry as established in Article 9 (§ 32.1-70 et seq.) of Chapter 2 of Title 32.1 to determine the (i) completeness of the data, i.e., whether all necessary reporting sources are required to submit data to enable the registry to collect comprehensive cancer surveillance data; (ii) timeliness of the data reporting, collation, and analyses; (iii) manner and thoroughness of the data collation, including, but not limited to, any geographic and population subcomponents; (iv) uses of the data for prevention, intervention, and treatment analyses and strategies, including education of the public, medical and health services research, treatment evaluations, and public health intervention and prevention; (v) access to the data by experts for research purposes and by the public for educational purposes; (vi) confidentiality of the data in both statistical and individual form and whether individual data should be available to any researchers, the subject of the data or the subject's family and, if so, the scope of the information to be disclosed and the circumstances for disclosure; (vii) legal basis for the registry and whether this legal authority as reflected in Title 32.1 of the Code of Virginia is sufficient to serve the Commonwealth in monitoring cancer incidence and mortality, guiding cancer control planning and evaluation, assisting in prioritizing health resource allocations, advancing medical and public health research, and contributing to the development of both a Virginia and a national cancer control strategy; and (viii) principles and practices currently in use for cancer control in Virginia and the necessary revisions to these strategies to improve the synergism, sustainability, and effectiveness of the Commonwealth's cancer control efforts.

Vehicle seizure. Directs the Virginia State Crime Commission to study alternative means of sanctioning habitual offenders of the Commonwealth's laws regarding the operation of motor vehicles and to examine the effectiveness of vehicle seizure in reducing re-arrests among recalcitrant drunk drivers. The Commission is directed to (i) determine those offenses relating to the operation of a motor vehicle that pose the greatest threat to the citizens of the Commonwealth; (ii) develop additional or alternative sanctions or methods to restrict the access habitual offenders have to motor vehicles and equipment; (iii) investigate the feasibility of implementing a vehicle seizure program; and (iv) determine the effectiveness of such programs.

Requests the Office of the Secretary of Commerce and Trade to study the effect of the Commonwealth's insurance gross premiums tax rates on its ability to attract insurance businesses. The study shall address the probable effects of a reduction in the rate of Virginia's gross premiums tax on (i) efforts to attract insurance companies to the Commonwealth, (ii) the Commonwealth's general fund revenue, and (iii) the retaliatory tax burden borne by insurers currently domiciled in the Commonwealth.

Educational needs of the 21st Century. Establishes a special task force of the Commission on Educational Accountability to study the educational needs of the 21st century. The study will examine (i) the integration of the Standards of Learning with middle and high school curricula and programs that focus on workforce development skills; (ii) the availability of these middle and high school workforce development opportunities to students across the Commonwealth; (iii) the adequacy of current curricula, program resources, and technology in the public schools statewide; (iv) staffing and state and local funding levels for middle and high school workforce development programs; (v) the efficacy of current state and local coordination and governance of middle and high school workforce development programs; (vi) the need for training and technical assistance for workforce development educators; (vii) the use of the Standards of Learning and national business and industry standards to enhance the quality of these curricula and programs; (viii) issues raised in HJR 586 (1999) and HJR 657 (1999); and (ix) such other issues as it deems appropriate.

Creates a joint legislative study committee to evaluate the reliability of each of the various mechanisms that owners or operators of solid waste management facilities may use in Virginia to demonstrate financial assurance for the costs of closure, post-closure care and corrective action. Particular attention is to be given to the use of "self-assurance" mechanisms, including insurance coverage provided by captive insurance companies, and to financial tests and corporate guarantees. The joint legislative study committee is to make recommendations and provide options for regulatory or legislative actions that would improve the reliability of financial assurance mechanisms.

Postdispositional detention. Directs the Commission on Youth to study the use of postdispositional detention in juvenile detention homes. Currently the Department of Juvenile Justice standards do not allow the use of postdispositional detention if a secure detention facility is at capacity. During the course of its study, the Commission shall review the requirements of the Mammography Quality Standards Act and the provisions of the reauthorization of the Act to determine specifically the obligation, rights, and responsibilities of states in accrediting, certifying, inspecting, and monitoring mammography facilities, including reviewing and enforcing the qualifications for competent staff. The Commission shall also review the arrangements between the U.S. Federal Food and Drug Administration and the State Health Department's Bureau of Radiological Health for the inspection of mammography facilities; estimate the costs of accrediting and certifying such facilities to the state; determine the feasibility and appropriateness of an interagency approach to enforce federal quality control requirements at the state level; and recommend ways which would enable the Commonwealth to ensure quality among mammography facilities and the medical personnel who work in them.

Issues to be addressed include: (i) changes needed in the Code of Virginia to better accommodate leasing for intensive aquaculture operations; (ii) development of criteria which the Virginia Marine Resources Commission (VMRC) would use to identify areas on state-owned bottomland (not included in the Baylor survey) where leases would be granted for intensive aquaculture operations; and (iii) changes needed in the Code of Virginia to allow VMRC to designate submerged aquatic vegetation restoration areas as components of leases contingent on the development of criteria, including geographic criteria, of areas likely to support submerged aquatic vegetation re-growth and restoration.

This resolution notes the 1998 activities of the Commission, which included data and background on Virginia construction and educational technology programs; presentations from officials representing North Carolina, Ohio, and West Virginia; a review of construction issues in other states in the Southern region; and input from local governments and school boards. The Commission also developed and conducted a school facility survey and reviewed the survey results during the course of several work sessions. The Commission's discussions resulted in preliminary agreement on a funding stream and various distribution principles, such as flat grants, weighted average daily membership, and local growth and emergency situations; however, the development of the details of any funding mechanism will require additional study. Therefore, the Commission is charged with evaluating the components of its 1998 principles and developing the mechanisms that are necessary for their operation.

During the 1998 interim, the Joint Subcommittee received testimony and presentations on important issues relating to lead poisoning from the Centers for Disease Control and Prevention, parents of children with lead poisoning, and real estate professionals. The issues brought to the Joint Subcommittee's attention require expansion of the study committee to include additional legislative members, a parent of a child with lead poisoning, a physician with expertise in treating lead poisoning, a lead abatement contractor, a local building official, a member of a local governing body, one real estate professional, and one expert in assisting real estate professionals in averting liability for lead poisoning. The Joint Subcommittee Studying Lead Poisoning Prevention is directed to (i) receive reports and data and make recommendations on appropriate lead risk reduction policy in the Commonwealth; (ii) receive reports and data on the concerns related to liability for lead in housing and assess possible solutions to these concerns; (iii) receive reports and data on the prevention of lead poisoning among the citizens of the Commonwealth, particularly children; (iv) strive to involve building officials and other local government officials in the work to avert lead poisoning; (v) receive reports and data relating to medical guidelines for the prevention, diagnosis, and treatment of lead poisoning, particularly among children; (vi) work with the Board of Medicine, the Medical Society of Virginia and others in providing education to the public and the medical community concerning prevention, diagnosis, and treatment of lead poisoning; and (vii) evaluate such other issues as it may deem necessary in alleviating this serious problem in Virginia.

Directs the Commission on Educational Accountability to study the efficacy, appropriateness, and application of the Commonwealth's statutes, regulations, and policies governing the academic assessment of students who transfer into Virginia public schools. The commission is to examine, among other things, current course and assessment requirements articulated in the Standards of Quality and the Standards of Accreditation as well as current accommodations granted to certain student populations, such as ESL students; specific data regarding numbers and grade levels of nonpublic school students transferring to Virginia public schools; testing practices and graduation requirements for transfer students in other states; and other matters it deems appropriate.

The real estate professionals who testified to the Joint Subcommittee Studying Lead-Based Paint Abatement in 1998 also noted that housing insurance policies consistently exclude lead-poisoning risks for older houses and multiple family units. Some states have passed laws relating to liability exposure for lead-poisoning risks; however, the Joint Subcommittee believes that careful study is necessary before coming to any conclusions about the efficacy of such other state laws. Therefore, the experts within the State Corporation Commission are being requested to examine these issues and make recommendations.

The Joint Subcommittee Studying Lead Poisoning Prevention is directed to receive reports and data on (i) lead risk reduction policy in the Commonwealth and make appropriate recommendations; (ii) the concerns related to liability for lead in housing and assess possible solutions to these concerns; (iii) the prevention of lead poisoning among the citizens of the Commonwealth, particularly children; and (iv) medical guidelines for the prevention, diagnosis, and treatment of lead poisoning, particularly among children. The subcommittee is also directed to strive to involve building officials and other local government officials in the work to avert lead poisoning; work with the Board of Medicine, the Medical Society of Virginia and others in providing education to the public and the medical community concerning prevention, diagnosis, and treatment of lead poisoning; and evaluate such other issues as it may deem necessary in alleviating this serious problem in Virginia. The issues brought to the Joint Subcommittee's attention require expansion of the subcommittee to include additional legislative members, a parent of a child with lead poisoning, a physician with expertise in treating lead poisoning, a lead abatement contractor, a local building official, a member of a local governing body, one real estate professional, and one expert in assisting real estate professionals in averting lead poisoning.

Requests public and private institutions of higher education to provide information on consumer credit and the dangers of substantial credit card debt to students and their parents during freshman orientation, and together with other notices, bills, and information. For many students, the use of credit cards has become a way of life and few students know or understand the principles and benefits of sound money management and good credit. Many college students exacerbate their situation by adding credit card debt to student loan debt. In many instances they graduate without a job, owing substantial credit card balances and student loans, while plagued by poor credit. Minority and low-income students generally have less resources for college and are more vulnerable to the credit card message. Because many employers conduct a credit check on prospective employees, college students and their parents need to be aware that poor credit can follow them, affecting their housing options, the ability to buy a car, the ability to complete undergraduate school or to pursue graduate education and professional school, and the ability to obtain employment. This resolution is a recommendation of the Joint Subcommittee Studying the Status and Needs of African-American Males in Virginia.

The joint subcommittee must conduct its study in two phases, as required in City of Richmond v. J. A. Croson Co., 488 U.S. 469 (1989). During the first phase of the study, the joint subcommittee shall review the Supreme Court's decisions in Croson and Adarand Constructors v. Pena, 115 S. Ct. 2097 (1995), examine commodities, contractual services, architectural and engineering services, and construction contracts relative to state government procurement practices and procedures. "Driving while black" (DWB). Establishes a joint subcommittee to study racial profiling and pretextual traffic stops of minority drivers, known as "driving while black" (DWB). The joint subcommittee is requested to compile and analyze statistical data regarding police traffic stops in Virginia, particularly along Interstate 95. Also, the joint subcommittee is required to review and consider the legal principles of the Fourth and Fourteenth Amendments relative to pretextual traffic stops, racial profiling, and constitutional protections and restraints. Information regarding traffic stops litigation, whether similar problems occur in Virginia, certain legislation proposed in Congress addressing pretextual traffic stops, and remedies ordered by the courts and settlement agreements reached by litigants must also be considered, among other things, for applicability in the Commonwealth. The phenomenon known as "driving while black" in which African-American and other minority motorists are frequently stopped, held, and searched without cause and charges never filed, has reached crisis proportions. Based on their daily experiences, many African-Americans and other minorities believe that police officers may enforce the law arbitrarily and capriciously, with bias and prejudice and with impunity. Many such persons also believe that the protections afforded citizens in the United States Constitution do not extend to them because the police may circumvent Constitutional protections and restraints when dealing with minorities. Many people believe that this situation is volatile, and that if the problem is not quickly and appropriately addressed, the resentment and contempt for American justice and law-enforcement officers in the minority community will threaten the rule of law.
